The Register of disciplinary action displayed on the Board’s website reflects all disciplinary action taken against Australian legal practitioners under the Legal Profession Act 2004 (Vic) (“the Act”) which has been in existence since 12 December 2005.
The Register includes:
Action taken under the previous legislation, the Legal Practice Act 1996 (Vic), whether concluded before or after 12 December 2005, does not appear on the Register at this time.
“Disciplinary action” includes:
Details of disciplinary action taken against an Australian legal practitioner will not be recorded on the Register while the decision remains subject to appeal or if an appeal proceeding relating to that decision is yet to be finally determined.
Information is to be kept on the Register for five years after the disciplinary action is taken, or (if the disciplinary action exceeds 5 years) as long as the disciplinary action applies.
