How to make a claim

To make a claim against the Fidelity Fund you need to complete a Fidelity Fund claim form.

You may engage a legal representative for the purposes of making a claim against the Fidelity Fund.

The Board may require a claimant to produce or deliver any security, document or statements of evidence necessary or available to:

Failure to supply further information may result in the claim being disallowed.

Time limits on claims and notices calling for claims

You must lodge a claim with the Board within six months of becoming aware of the default.

However, if the Board considers there has been a default by a law practice it may publish a notice in relevant print media, calling for claims to be lodged. The notice may specify a date by which the Board must receive all claims, being no less than three months, and no more than 12 months after the date of publication of the notice. Current notices calling for claims are set out below.

There are currently no notices calling for claims.

Late claims

In the event that a claimant does not make a claim within the 6 month claim period the Board may still accept the claim. In the event that you wish to make a claim which is outside the statutory timeframe please ensure that your application is accompanied by a detailed explanation for the delay. If the Board does not accept a late claim, you are entitled to apply to the Supreme Court to have the statutory timeframe extended.
